1. About Élan Reserve

Élan Reserve is the registered trade name of ELAN BEYOND LLC, a New Jersey limited liability company (the "Company," "we," "us," or "our"). We operate the website elanandco.co and act as an online retailer of premium home wellness, outdoor, and recovery products manufactured by independent third-party suppliers.

By accessing, browsing, or purchasing through elanandco.co, you ("Customer," "you") agree to these Terms of Service. If you do not agree, do not use the site or purchase products.

2. No Medical Advice — Wellness Products

Products sold by Élan Reserve — including but not limited to infrared and traditional saunas, cold plunges, hyperbaric chambers, and red light therapy devices — are wellness equipment, not medical devices. Any information on our site, in product descriptions, blog posts, marketing materials, or correspondence regarding health benefits (including but not limited to inflammation reduction, recovery, sleep, longevity, mental health, or athletic performance) is provided for educational and informational purposes only. None of these statements have been evaluated by the United States Food and Drug Administration (FDA). Our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Consult a licensed physician before beginning any new wellness regimen, particularly if you are pregnant, have a heart condition, high or low blood pressure, diabetes, recent surgery, an implanted medical device, an autoimmune disorder, or are taking medication.

3. Assumption of Risk

You acknowledge and agree that saunas, cold plunges, hyperbaric chambers, fire features, and outdoor recovery equipment involve inherent physical risks including but not limited to: extreme temperature exposure, atmospheric pressure changes, electrical shock, slip and fall, burns, frostbite, drowning, fire, fall from height, and other injuries. By purchasing, you expressly and voluntarily assume all such risks, whether known or unknown, that may arise from the ownership, installation, operation, or use of any product purchased from Élan Reserve. You agree to read and follow all manufacturer-provided instructions, warnings, and warranty terms. You agree to consult the manufacturer or a qualified professional regarding installation requirements (electrical capacity, foundation, ventilation, plumbing, drainage, structural load, clearances).

4. Limitation of Liability

To the maximum extent permitted by law, in no event shall ELAN BEYOND LLC d/b/a Élan Reserve, its members, officers, agents, employees, or affiliates be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost data, personal injury, property damage, or business interruption, arising out of or related to your purchase or use of any product, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any and all claims arising out of or related to a product purchase shall not exceed the actual purchase price you paid for the specific product giving rise to the claim, excluding shipping, taxes, and fees.

Some jurisdictions do not allow the exclusion or limitation of certain damages — in those jurisdictions, our liability is limited to the maximum extent permitted by law.

5. Indemnification

You agree to defend, indemnify, and hold harmless ELAN BEYOND LLC d/b/a Élan Reserve, its members, officers, agents, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your misuse of any product; (b) your failure to follow manufacturer instructions, warnings, or warranty terms; (c) installation by an unqualified person or in a non-compliant environment; (d) modification or alteration of the product; (e) your violation of these Terms or any applicable law; or (f) your infringement of any third-party right.

6. Manufacturer Relationships

Élan Reserve is an online retailer that works directly with the manufacturers whose products appear on our site. Each product is fulfilled directly from the manufacturer or their designated distribution partner. The manufacturer's warranty applies and is preserved through purchase from us. We do not manufacture any products and make no independent product warranty beyond the manufacturer's stated warranty.

7. Pricing, Availability, and Errors

All prices are in U.S. dollars and exclude applicable taxes unless stated. We reserve the right to correct pricing errors, modify product specifications, or discontinue any product at any time without notice. If a pricing or product description error is identified after an order is placed, we will contact you and may cancel the order with a full refund.

9. Governing Law and Venue

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your purchase shall be resolved exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of those courts.

10. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continued use of the site after an update constitutes acceptance of the revised Terms.
